1) التعريفات ونطاق التطبيق
تشير كلمات «نحن/لنا/لدينا» إلى AX Store. وتشير كلمة «العميل/أنت» إلى أي مستخدم يزور الموقع أو ينشئ حسابًا أو يقدّم طلبًا.
تنطبق هذه الشروط على استخدامك للموقع وجميع عمليات الشراء والخدمات والميزات المرتبطة به، سواءً عبر الكمبيوتر أو الجوال أو أي جهاز آخر.
باستخدامك للموقع أو إتمامك لعملية شراء، فإنك تقر بأنك قرأت وفهمت ووافقت على هذه الشروط، وعلى السياسات المرتبطة أدناه:

2) المنصة والاستضافة
قد تكون منصة المتجر مستضافة/مدارة عبر مزود منصة تجارة إلكترونية بهدف تمكين عرض المنتجات وإتمام عمليات الشراء. لا يغيّر ذلك من سريان هذه الشروط بينك وبين AX Store.
3) الأهلية وإنشاء الحساب
- قد يتطلب الشراء إنشاء حساب أو تزويدنا ببيانات صحيحة (الاسم، رقم الهاتف، البريد الإلكتروني، العنوان).
- أنت مسؤول عن الحفاظ على سرية كلمة المرور وبيانات الحساب وعن أي نشاط يتم عبره.
- إذا كان عمرك أقل من 18 سنة، يجب استخدام الموقع تحت إشراف ولي أمر/وصي وبوسيلة دفع مصرح بها.
- يحق لنا تعليق/إيقاف الحساب أو تقييد الوصول عند الاشتباه في نشاط غير نظامي أو إساءة استخدام أو بيانات غير صحيحة.
4) دقة المعلومات والمحتوى
- قد يحتوي الموقع على معلومات عامة أو وصف منتجات مقدم من المصنع/المورد. نسعى للدقة ولكن قد تحدث أخطاء مطبعية أو فروقات بسيطة.
- صور المنتجات والألوان قد تختلف حسب إعدادات الشاشة والإضاءة.
- يحق لنا تعديل/تحديث أي محتوى بالموقع في أي وقت دون إشعار.
5) الأسعار والتوفر وأخطاء الإدراج
- الأسعار والتوفر قابلة للتغيير دون إشعار.
- في حال وجود خطأ واضح في السعر أو الوصف أو التوفر، يحق لنا تصحيح الخطأ أو إلغاء الطلب وإشعار العميل.
6) الطلبات وتكوين العقد (Order Acceptance)
- إتمامك للطلب يعتبر «عرض شراء» من طرفك.
- يتم قبول الطلب وتكوين العقد عند تأكيد تجهيز/شحن الطلب أو تسليمه (بحسب الحالة).
- تأكيد الطلب الآلي أو رسالة الاستلام لا تعني قبول الطلب نهائيًا.
- قد نرفض/نلغي الطلب في حالات مثل: فشل الدفع، عدم توفر المخزون، خطأ إدراج، اشتباه احتيال/إساءة استخدام.
7) الدفع والتحقق
- وسائل الدفع المتاحة تظهر في صفحة الدفع.
- قد نطلب تحققًا إضافيًا لحماية العميل والمتجر عند وجود مؤشرات خطورة.
- في حال عدم القدرة على توفير المنتج بعد خصم المبلغ، سنقوم بإشعار العميل وإرجاع المبلغ حسب وسيلة الدفع وبما يتوافق مع الإجراءات البنكية.
8) الدفع بالتقسيط (Tabby / Taly / Deema وغيرها)
- خدمات التقسيط تقدمها جهات خارجية وفق شروطها وسياساتها. العميل مسؤول عن قراءتها وفهمها قبل إتمام الطلب.
- دور AX Store يقتصر على توفير خيار التقسيط كوسيلة دفع وتنفيذ الطلب وفق سياسات المتجر.
- أي خلاف/رسوم/قرارات/نزاعات تخص جهة التقسيط هي بين العميل وجهة التقسيط فقط، ولا يتحمل AX Store أي مسؤولية عنها.
- أي حقوق/استثناءات خاصة بالمتجر (مثل عدم الإلغاء/الاسترجاع لبعض الفئات) تكون حسب صفحة Returns & Refunds Policy.
9) التوصيل والاستلام
- العميل مسؤول عن إدخال عنوان صحيح وواضح وبيانات تواصل فعّالة.
- مواعيد التوصيل تقديرية وقد تتأثر بعوامل تشغيلية/لوجستية.
- يُعد توقيع العميل/ممثله أو أي إثبات تسليم معتمد إقرارًا بالاستلام.
- قد تُطبق شروط إضافية لبعض المناطق/الخدمات حسب ما يظهر عند إتمام الطلب.
10) الإلغاء والاسترجاع والضمان
تخضع جميع الإلغاءات/الاسترجاع/الاستبدال/الضمان وخطة حماية التقسيط إلى سياسة المتجر المنشورة في صفحة:

11) أدوات وروابط الطرف الثالث
- قد نتيح أدوات/روابط لطرف ثالث «كما هي» دون ضمان، ولا نتحمل مسؤولية محتواها أو خدماتها.
- أي تعامل مع طرف ثالث يكون على مسؤوليتك وبموجب شروطه الخاصة.
12) سلوك المستخدم والاستخدامات المحظورة
يحظر استخدام الموقع أو محتواه لأي غرض غير قانوني، بما في ذلك (على سبيل المثال لا الحصر): الاحتيال، استخدام وسائل دفع غير مصرح بها، نشر برمجيات خبيثة، جمع بيانات المستخدمين دون إذن، أو أي إساءة استخدام قد تضر بالمتجر أو بالغير.
يحق لنا إنهاء أو تعليق الوصول عند مخالفة هذه الشروط.
13) إخلاء المسؤولية وحدودها
- يتم توفير الموقع والخدمات «كما هي» و«حسب التوفر» دون ضمان تشغيل دون انقطاع.
- لا نتحمل أي خسائر غير مباشرة (مثل فقدان بيانات/خسارة أرباح/توقف أعمال).
- مسؤولية AX Store — إن وجدت — تقتصر على قيمة المنتج محل المطالبة وبالحد الأقصى المسموح به قانونًا.
14) التعويض
يوافق العميل على تعويض AX Store عن أي مطالبات أو أضرار أو تكاليف تنشأ بسبب مخالفة هذه الشروط أو إساءة استخدام الموقع أو انتهاك حقوق الغير.
15) قابلية الفصل
إذا اعتُبر أي بند غير قابل للتنفيذ، تبقى بقية البنود سارية بالقدر المسموح به قانونًا.
16) الإنهاء
يحق لنا إنهاء أو تعليق وصولك إلى الموقع عند مخالفة الشروط أو الاشتباه في إساءة استخدام. وتبقى الالتزامات التي نشأت قبل الإنهاء سارية.
17) القانون والاختصاص
تخضع هذه الشروط لقوانين دولة الكويت، وتكون المحاكم الكويتية جهة الاختصاص.
18) التعديلات على الشروط
يحق لنا تحديث هذه الشروط في أي وقت بنشر النسخة المحدثة على هذه الصفحة. استمرارك في استخدام الموقع بعد التحديث يعني موافقتك على النسخة الجديدة.

1) Scope & Acceptance
These Terms govern your use of AX Store and all purchases made through the website. By accessing the website and/or placing an order, you confirm that you have read, understood, and agreed to these Terms and the policies referenced below:

2) Platform / Hosting
The store may be hosted/operated on an e-commerce platform provider to facilitate online sales. This does not affect the applicability of these Terms between you and AX Store.
3) Eligibility & Accounts
- You may need an account and accurate contact/delivery details to purchase.
- You are responsible for safeguarding your login credentials and all activity under your account.
- If you are under 18, you may only use the website under a parent/guardian’s supervision using an authorized payment method.
- AX Store may suspend accounts or refuse orders where misuse, inaccurate data, or irregular activity is suspected.
4) Information Accuracy
- Product descriptions may be supplied by manufacturers/suppliers. We strive for accuracy, but errors may occur.
- Colors/images may vary depending on device/display settings.
- We may update website content at any time without notice.
5) Pricing, Availability & Listing Errors
- Prices and availability may change without notice.
- If an obvious pricing/description/availability error occurs, AX Store may correct the error or cancel the order and notify the customer.
6) Orders & Acceptance
- Your order constitutes an offer to purchase.
- Acceptance occurs when we confirm processing/dispatch or deliver the order (as applicable).
- Automatic acknowledgments do not constitute acceptance.
- We may cancel/refuse orders due to payment failure, stock unavailability, listing errors, or suspected fraud/misuse.
7) Payments & Verification
- Payment methods are shown at checkout.
- Additional verification may be required for security and fraud prevention.
- If we cannot fulfill an item after payment is captured, we will notify you and process a refund via the original payment method, subject to bank/provider processing timelines.
8) BNPL Providers (Tabby / Taly / Deema, etc.)
- BNPL services are offered by third-party providers under their own terms and policies. You are responsible for reviewing them before placing an order.
- AX Store’s role is limited to providing BNPL as a payment option and fulfilling orders under AX Store policies.
- Any BNPL-related disputes, fees, decisions, or claims are strictly between the customer and the BNPL provider, and AX Store assumes no responsibility for matters arising between them.
- Store-specific rules (including exclusions from cancellation/returns) are governed by the Returns & Refunds Policy.
9) Delivery & Receipt
- You must provide a valid and clear delivery address and contact details.
- Delivery timelines are estimates and may vary due to operational factors.
- A signature or accepted proof of delivery is considered confirmation of receipt.
- Additional conditions may apply for certain areas/services as shown at checkout.
10) Cancellations, Returns & Warranty
All cancellations, returns, exchanges, refunds, warranty procedures, and BNPL Protection Plan terms are governed by our published:

11) Third-Party Tools & Links
We may provide access to third-party tools/links “as is” without warranties. Any interaction with third parties is at your own risk and subject to their terms.
12) Prohibited Uses
You may not use the website for unlawful purposes, fraud, unauthorized payments, malware transmission, scraping, harassment, or any misuse that harms AX Store or others. We may terminate access for violations.
13) Disclaimers & Limitation of Liability

- AX Store is not liable for indirect or consequential damages (data loss, lost profits, downtime).
